Daniel Brady Joins Firm’s Partnership.

Hagerty & Brady is pleased to announce that Daniel J. Brady has become a partner.  Dan joined the firm in 2015 as an associate after practicing at some larger regional law firms in Buffalo.  A 2011 graduate of University at Buffalo Law School, Dan entered the Marine Corps after graduation and served as a Marine Officer until late 2013.  During this time, he served as an Assistant Staff Judge Advocate to the Commanding General of II Marine Expeditionary Force and was later appointed a Special Assistant United States Attorney for the District of Maryland by then US Attorney Rod Rosenstein. He also served in the Office of General Counsel for Office of the Director of National Intelligence and National Counterterrorism Center in Washington, DC.

Since joining Hagerty & Brady, Dan has handled multiple litigation matters in federal and state court, including obtaining a successful verdict on behalf of his injured client before a Tompkins County jury, as well as obtaining summary judgment in a complex civil RICO lawsuit, then successfully defending that decision before the Second Circuit Court of Appeals.  

Dan is also an active member of the Buffalo community.  He serves as a board member of Vision Niagara, a not for profit on the West Side of Buffalo, and is an Imagine LaSalle focus group member, deeply involved in the process of transforming LaSalle Park into the world class Ralph C. Wilson, Jr. Centennial Park.

Hagerty & Brady was formed in 1989 by Michael A. Brady and Thomas V. Hagerty, but our firm traces its roots to Hagerty & Hagerty, where Thomas V. Hagerty worked with his father, James J. Hagerty. James J. Hagerty had followed in the footsteps of his father, Leo J. Hagerty, who began his legal career as Assistant District Attorney in Erie County, served as District Attorney of Erie County, and finally as a Supreme Court Justice in the Eighth Judicial Court.  We take pride in a legacy of professionalism and client service.

EMPLOYEE BENEFITS litigation

Hagerty & Brady has represented clients in their claims for employee benefits against large regional employers, including Fortune 500 companies. Employee benefits include such things as healthcare coverage, the right to continuation of healthcare coverage, retirement and 401(k) plans, and severance benefits. Federal law protects employees’ right to seek redress against arbitrary and capricious terminations or denials of benefits related to their employment. In many cases, employees are also entitled to have their employers pay the legal fees associated with their claim, meaning that an employee or former employee does not have to go out of pocket in order to have his or her day in court.

Our firm has extensive experience representing municipal defendants in all types of litigation.  We are sensitive to the vulnerability of municipal clients to frivolous claims and expensive litigation.  We use our deep knowledge of the unique defenses available to municipal and government defendants to minimize the litigation costs incurred by municipalities and, where possible, return money to municipal coffers.

Hagerty & Brady has extensive experience in probating decedents' estates. We represent our clients' interests fully from initial consultation and appointment of the estate representative through final distribution and accounting. Our firm is experienced in preparing wills and testamentary trusts, handling guardianship proceedings, and representing estates, distributees, and beneficiaries in the course of probate proceedings and administration. We also represent clients in matters involving probate litigation, such as will contests and objections to accounting.

insurance Defense

Our firm has provided legal services to some of the largest insurance carriers in the industry, both domestic and foreign, as well as many businesses on liability insurance issues. Mediation/Arbitration

Michael Brady was selected to serve on the panel of mediators for the Western District of New York’s ADR Program, for which he received extensive mediation training by the International Institute for Conflict Prevention & Resolution.  Mr. Brady has mediated well over 100 Federal Court lawsuits, including wrongful death actions, commercial disputes, trademark litigation, admiralty disputes, personal injury actions, FDCPA actions and numerous other matters.  Mr. Hagerty has also served as a mediator for private parties, especially in the area of health care disputes.

In addition to mediation, members of our firm have extensive experience serving as arbitrators.   Together, Mr. Hagerty, Mr. Brady, and Mr. Hunter have arbitrated hundreds of matters.  Mr. Hagerty is one of the few attorneys certified to sit as an arbitrator for the U.S. District Court, Western District of New York.

We assist clients in selecting a business entity appropriate to their objectives, tax purposes, and the nature of business operations, as well as minimization of their risks and liabilities. We also advise and draft documentation for businesses in transactional matters.   We also handle real estate matters for our business clients, including commercial leasing, purchases and sales of real estate, and construction loans.


Toxic tort/asbestos

Hagerty & Brady has long been engaged in the defense and handling of claims at the request of major manufacturers in the chemical and asbestos industries. We have worked closely with corporate counsel at some of the country's top companies and served as local counsel to some of the country's top national trial firms and national coordinating counsel. 

Mr. Hagerty's career over the past thirty years has involved the defense of diverse entities in asbestos litigation. He has represented major insulation manufacturing companies, employers, and manufacturers of floor tile, friction products, pumps, valves, automotive and trucking equipment and premises owners.


Aviation law

Hagerty & Brady has been involved in the defense of numerous general aviation accident cases and other aviation related litigation, in both state and federal courts, on behalf of aircraft component manufacturers and major air carriers.  We have worked with many aviation experts from across the country in the defense of our clients.  Most recently, our firm served as local counsel for one of the central defendants in the Flight 3407 litigation.


General Civil litigation

Hagerty & Brady has concentrated its practice in general civil litigation, and has long and broad experience in state and federal courts - both in New York State and elsewhere. Our firm has represented clients as plaintiffs and defendants in civil claims that cover a wide range of legal areas, including personal injury, subrogation actions, insurance coverage, commercial disputes, defamation claims, and intellectual property.  We have also provided local counsel work for major firms in New York City, Boston, Pittsburg, Philadelphia, Chicago, Los Angeles and Washington D.C., in these areas throughout upstate New York.
